The ordinance of October 13, 1945 defines and organizes the occupation of contractor of spectacle and sets up the licence. The licence is obligatory for any person in charge for associative or commercial structure whose usual activity is the production of spectacles. It has as a goal of professionnaliser the field of the spectacle living and to check the regularity of the situation of the contractor of spectacles taking into consideration its social obligation and lawful. Definition of alive spectacle : " production including/understanding the physical presence of at least an artist of the spectacle perceiving a remuneration at the time of the representation in public of work of the spirit " Definition of contractor of spectacle : " It is articulated around three trades which are not incompatible between them : owners of places of spectacles arranged for public representations, producing of spectacles or contractors of round-diffusers of spectacles " |
Who has to ask for the licence? |
| Any contractor of spectacles must ask for a licence, which it acts of an associative or commercial structure, private or public. Case of exemptions : occasionally to carry on the activity of contractor of spectacles, i.e. to produce to the maximum six representations per annum, that it acts of a person or entity of which the principal activity is not the exploitation of places of spectacles, nor production or diffusion of spectacles, of a group of voluntary artists amateurs making call at the time of remunerated artists. They is representations must be declared all the same at least a month before the date envisaged at the proper authority. |
Which licence to ask? |
| Licence of 1 era category : concern the owners of places of places of spectacles arranged for public representations. They must ensure some maintains it and installation for the hiring. Licence of 2 nde category : must be asked by the producers of spectacles or the contractors of rounds which have the responsibility for a spectacle like that of employer with regard to the artistic plate. It is them which choose and assemble the spectacles, coordinate the means human, financial, technical and artistic. They thus assume the responsibility for it. Licence of 3 2nd category : address yourself to the diffusers spectacles which have the load of the reception of the public, ticketting and safety. It concerns also the contractors of rounds which do not have the responsibility for employer. |

Period of validity of the licence |
| The licences are allotted for one three years duration. The refusal of renewal or the revocation of licence can be pronounced by the advisory commission, but not before the interested party was warned by letter registered with a request for notice of receipt of the reasons called upon in support of measurement considered. The holder of the licence has a 8 days deadline to present his observations. Will know that the contractors having a licence are subjected to certain controls, not of the artistic quality of the project but of the regularity of its situation in comparison with the lawful principles as regards social protection, of administration and jurisprudence. |
